Privacy policy DaCast online video platform

1. WHAT INFORMATION I-STREAMLIVE COLLECTS FROM YOU

I-STREAMLIVE may collect two (2) types of information about you: Personal and Non-Personal.

1.1 Personal Information

Personal Information refers to information that lets I-STREAMLIVE know the specifics of who you are and which may be used to identify, contact or locate you (e.g. name, mailing address, telephone number and e-mail address). I-STREAMLIVE may collect Personal Information when you use the I-STREAMLIVE Properties including, without limitation, setting up account information, filling out surveys, corresponding with I-STREAMLIVE, or otherwise volunteering information about yourself.

2.1 Non-Personal Information

Non-Personal Information refers to information that, by itself, does not identify you as a specific individual (e.g. demographic information or website visitations). I-STREAMLIVE may collect Non-Personal Information through any of the methods discussed above as well as automatically through use of industry standard technologies described further below.

2. HOW I-STREAMLIVE COLLECTS YOUR INFORMATION

The Personal Information practices set forth apply to all I-STREAMLIVE's customers worldwide.

2.1. Registration

Prior to using one or more of the I-STREAMLIVE Properties, those in use now and those which may be developed at a later date, I-STREAMLIVE may require certain Personal Information and Non-Personal Information to create an individual account ("Account") or to enable features or functionality of the I-STREAMLIVE Properties. Failure to provide all required information required by I-STREAMLIVE may prevent access to any or all I-STREAMLIVE Properties, and failure to maintain accurate information may result in suspension or termination of access to any or all I-STREAMLIVE Properties.

2.2 Information Collected Through Technology

While you are able to visit the I-STREAMLIVE Site and remain anonymous, I-STREAMLIVE or its third party service providers may still collect Non-Personal Information about your use of the I-STREAMLIVE Properties (e.g. your Internet browser, operating system, IP address, connection speed, and the domain name of your Internet service provider). Such information may be gathered by the following methods:

(a) Cookies. Cookies, including local shared objects, are small pieces of information that are stored by your browser on your computer's hard drive which work by assigning to your computer a unique number that has no meaning outside of the I-STREAMLIVE Site. Cookies do not generally contain any Personal Information. Most web browsers automatically accept cookies, but you can usually configure your browser to prevent this. Not accepting cookies may make certain features of the I-STREAMLIVE Properties unavailable to you.

(b) IP Address. You may visit many areas of the I-STREAMLIVE Site anonymously without the need to become a registered User. Even in such cases, I-STREAMLIVE may collect IP addresses automatically. An IP address is a number that is automatically assigned to your computer whenever you begin Services with an Internet services provider. Each time you access the I-STREAMLIVE Site and each time you request one of I-STREAMLIVE's pages, the server logs your IP address.

(c) Web Beacons. Web beacons are small pieces of data that are embedded in web pages and e-mails. I-STREAMLIVE may use these technical methods in HTML e-mails that I-STREAMLIVE sends to Users to determine whether they have opened those e-mails and/or clicked on links in those e-mails. The information from use of these technical methods may be collected in a form that is Personal Information.

(d) Tracking Content Usage. If you use the I-STREAMLIVE Services and you post audio visual materials including, without limitation, text, logos, artwork, graphics, pictures, advertisements, sound and other related intellectual property contained in such materials (collectively, "Content") to your website or to a third party website, I-STREAMLIVE tracks and captures Non-Personal Information associated with User accounts and the use of Content.

3. HOW I-STREAMLIVE USES YOUR INFORMATION

3.1 System Administration

I-STREAMLIVE may use Non-Personal Information for the purposes of system administration, assisting in diagnosing problems with I-STREAMLIVE servers, monitoring I-STREAMLIVE's system performance and traffic on the I-STREAMLIVE Properties and to gather broad demographic information about I-STREAMLIVE customers.

3.2 Personalization

I-STREAMLIVE uses Cookies and IP Addresses to track features such as delivering Content specific to your interests and informing you of new, relevant services or certain third party offerings.

3.3 Notices to Registered Users

If you have registered for an Account, I-STREAMLIVE may use your Personal Information to send e-mails regarding your registration, including confirmation to verify the accuracy of any information you have provided, and instructions on how to post Content. I-STREAMLIVE may also send you e-mails to verify your identity or to notify you if I-STREAMLIVE believes your use of I-STREAMLIVE Properties violates any applicable agreement for the use of the I-STREAMLIVE Properties.

3.4 Advertising

I-STREAMLIVE may use Non-Personal Information to assist in optimizing the delivery of advertisements to viewers of your Content.

3.5 Promotional E-mails

I-STREAMLIVE may use your Personal Information to send you e-mails periodically listing promotions or events relating to the I-STREAMLIVE Properties or from I-STREAMLIVE's marketing partners or sponsors. You have the choice to opt-out of receiving such promotional e-mails by sending an e-mail to i-streamlive@yahoo.com and/or following the instructions in such correspondence. Once I-STREAMLIVE has processed your opt-out request, I-STREAMLIVE will not send you promotional e-mails unless you opt back in to receiving such communications.

3.6 Contact Information

If you contact I-STREAMLIVE by telephone, e-mail or letter, I-STREAMLIVE may keep a record of your contact information and correspondence. If you report a problem with the I-STREAMLIVE Properties, I-STREAMLIVE may collect this information in a file specific to you. You may contact I-STREAMLIVE at i-streamlive@yahoo.com to request the removal of this information from I-STREAMLIVE's database.

4. HOW TO ACCESS AND CHANGE YOUR PERSONAL INFORMATION

Upon request, I-STREAMLIVE shall allow Users to update or correct Personal Information previously submitted, but only to the extent such activities will not compromise privacy or security interests. Additionally, upon request, I-STREAMLIVE shall delete Personal Information from the database where such information is stored; however, it may be impossible to entirely delete a User's entry without some residual information being retained due to the manner in which data backups are maintained.

5. DISCLOSURE OF INFORMATION TO THIRD PARTIES

I-STREAMLIVE does not sell, trade or rent Personal Information collected through the I-STREAMLIVE Properties to any third party. Notwithstanding the foregoing, I-STREAMLIVE shall: (1) fully cooperate with law enforcement agencies; and (2) may be required to disclose Personal Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation.

6. SAFEGUARDING YOUR PERSONAL INFORMATION

6.1 Security Measures

I-STREAMLIVE takes appropriate security measures to protect against unauthorized access, alteration, disclosure or destruction of Personal Information. These include, but are not limited to, internal reviews of: (a) I-STREAMLIVE's data collection; (b) storage and processing practices; (c) electronic security measures; and (d) physical security measures to guard against unauthorized access to systems where I-STREAMLIVE stores Personal Information. All I-STREAMLIVE employees, contractors and agents who access Personal Information are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution or unauthorized use or disclosure of Personal Information.

The I-STREAMLIVE Properties may contain links to third parties who may collect Personal Information and Non-Personal Information directly from you. Additionally, I-STREAMLIVE may use third parties to provide components of the I-STREAMLIVE Properties. In either case, such third parties may have separate privacy policies and data collection practices, independent of I-STREAMLIVE. I-STREAMLIVE: (a) has no responsibility or liability for these independent policies or actions; (b) is not responsible for the privacy practices or the content of such websites; and (c) does not make any warranties or representations about the contents, products or services offered on such websites or the security of any information you provide to them.

7. CHANGES TO I-STREAMLIVE'S PRIVACY POLICY

I-STREAMLIVE continually strives to implement new technologies and processes to better protect you, your privacy and your use of the I-STREAMLIVE Properties. As a result, changes to this Privacy Policy may be made by I-STREAMLIVE from time to time. In no event will these changes result in the degradation of any of the security measures designed to protect you from unauthorized disclosure, as such measures are described in this Privacy Policy.

8. SPECIAL NOTE REGARDING CHILDREN UNDER 13 YEARS OF AGE

Use of the I-STREAMLIVE Properties is not intended for minors under the age of 18 ("Minors"). Minors are not authorized by I-STREAMLIVE to use the I-STREAMLIVE Properties, even if Minors set up an Account or accept the terms of any agreement for I-STREAMLIVE Properties. Parents or guardians may authorize Minors between the ages of 13 and 17 to use the I-STREAMLIVE Properties, provided they assume all responsibility and legal liability for the conduct of such Minor including, without limitation, monitoring the Minor's access and use of the I-STREAMLIVE Properties. I-STREAMLIVE does not intentionally collect nor maintain any personally identifiable information from Minors. If you discover your Minor child has submitted his/her information to I-STREAMLIVE, you may request to have such information deleted from I-STREAMLIVE's database by sending an e-mail request to i-streamlive@yahoo.com together with the e-mail address that was submitted by the Minor. 7.2. Security

We strive to keep Your Content secure, but cannot guarantee that we will be successful at doing so, given the nature of the Internet. Accordingly, without limitation to Section 4.3 above and Section 11.5 below, you acknowledge that you bear sole responsibility for adequate security, protection and backup of Your Content and Applications. We strongly encourage you, where available and appropriate, to (a) use encryption technology to protect Your Content from unauthorized access, (b) routinely archive Your Content, and (c) keep your Applications or any software that you use or run with our Services current with the latest security patches or updates. We will have no liability to you for any unauthorized access or use, corruption, deletion, destruction or loss of any of Your Content or Applications.

8. Fees

8.1. Service Fees

In consideration of your use of any of the Paid Services, you agree to pay applicable fees for Paid Services in the amounts set forth on the respective Service detail pages on the I-STREAMLIVE Website. You are responsible for any fees assessed by I-STREAMLIVE Payments for transactions that you submit to the Payment Service using I-STREAMLIVE. Fees for any new Service or new Service feature will be effective upon posting by us on the I-STREAMLIVE Website for the applicable Service. We may increase or add new fees for any existing Service or Service feature, or implement a fee for any previously Free Service or Free Service feature, by giving you 30 days' advance notice. Such notice will be posted on the I-STREAMLIVE Website on the Service detail page for the affected Service. You agree that you are responsible for checking the I-STREAMLIVE Website each month to confirm whether there are any new fees and their effective date(s). All fees payable by you are exclusive of applicable taxes and duties, including, without limitation, VAT and applicable sales tax. You will provide such information to us as reasonably required determining whether we are obligated to collect VAT from you, including without limitation your VAT identification number.

8.2. Payment

We may specify the manner in which you will pay any fees, and any such payment shall be subject to our general accounts receivable policies from time to time in effect. All amounts payable by you under this Agreement will be made without setoff or counterclaim and without deduction or withholding. If any deduction or withholding is required by applicable law, you shall notify us and shall pay such additional amounts to us as necessary to ensure that the net amount that we receive, after such deduction and withholding, equals the amount we would have received if no such deduction or withholding had been required. Additionally, you shall provide us with documentation that the withholding and deducted amounts have been paid to the relevant taxing authority.

8.3. Special Pricing Programs

From time to time, we may offer free or discounted pricing for compute capacity, data transfer, data storage, and other usage of certain Services (each a "Special Pricing Program"). After a Special Pricing Program ends, normal charges will apply. You must comply with any additional terms, restrictions, or limitations (e.g., limitations on the total amount of usage) we impose in connection with the Special Pricing Program as described on the Service-specific detail pages on the I-STREAMLIVE Website. You may not sign-up for multiple I-STREAMLIVE accounts in order to receive additional benefits under a Special Pricing Program. We may immediately terminate any account that we determine, in our sole discretion, is established or used to avoid the terms, restrictions, or limitations applicable to a Special Pricing Program. Any data stored as part of a Special Pricing Program must be actively used.

9.3. Conflict with Separate Non-Disclosure Agreement
